Welcome to CieloNYCDesigns! These Terms of Service govern your use of our website, https://cielonycdesigns.com, and purchases made through our online store.

CieloNYCDesigns is operated by Aeternis LLC. By accessing our website or placing an order, you agree to these Terms of Service, subject to applicable laws.

1. Products & Customization

CieloNYCDesigns specializes in personalized gifts, engraved products, custom awards, jewelry, and other made-to-order merchandise.

Because our products are individually customized, slight variations in color, engraving, positioning, material texture, or finish may occur.

Customers are responsible for reviewing product descriptions, dimensions, personalization options, and submitted information before completing a purchase.

2. Personalization Accuracy

Customers are responsible for ensuring all personalization details are accurate, including names, dates, messages, artwork, logos, and spelling.

We may reproduce personalization exactly as submitted.

CieloNYCDesigns is not responsible for errors resulting from incorrect customer-provided information. If a mistake is identified before production begins, customers should contact us immediately at dmherenyc@gmail.com.

We will make reasonable efforts to accommodate corrections, but changes cannot be guaranteed once production has started.

3. Order Cancellations

Cancellation requests must be submitted before production begins.

Once production has started, orders generally cannot be canceled because materials, labor, and customization processes have already been committed to the order.

Cancellation requests are subject to applicable consumer rights, including legally required cancellation or refund remedies for shipping delays.

4. Design Proofs & Approvals

Certain orders may require customer approval of artwork, digital proofs, or physical samples.

Customers are responsible for reviewing all submitted design details before granting approval.

Once approval is provided, production may begin based on the approved specifications.

Subsequent design changes may require additional fees or production time, subject to customer agreement.

Sample approvals may extend processing times by up to five additional business days, with further delays possible if customers request revisions or do not respond promptly.

5. Processing & Shipping

Standard orders containing 1–20 items are typically processed within 1–2 business days after payment confirmation.

Orders containing more than 20 items may require additional processing time.

Our daily order cutoff is 11:00 AM Eastern Time (ET), and our business days are Monday through Saturday, excluding applicable holidays.

Orders placed after the cutoff may begin processing on the next business day.

Shipping transit times are separate from production timelines. International shipping may involve customs processing, duties, and applicable import taxes.

If we are unable to ship within the promised timeframe, we will provide the required notice and options to consent to the delay or cancel for a refund, as applicable by law.

6. Returns, Refunds & Exchanges

Because most CieloNYCDesigns products are personalized or made to order, customized items are generally considered final sale.

We do not accept standard returns or issue refunds for change of mind, buyer's remorse, or incorrect personalization provided by the customer.

Exceptions and available remedies include the following:

Production Errors: If an item is produced incorrectly due to our mistake, we will provide a corrected replacement at no additional cost or a full refund, as appropriate.

Damaged Items: Customers are requested to report shipping damage within three days of confirmed delivery and provide photographs of the product, packaging, and shipping label. We will offer an appropriate replacement or refund after reviewing the claim.

Lost Shipments: If a shipment is confirmed lost and cannot be recovered, we will issue a full refund.

Significant Shipping Delays: If an order is substantially delayed without appropriate notice, customers may qualify for a full refund, including when required by law.

Partial Refunds: Partial refunds may be offered for minor cosmetic concerns or other mutually agreed resolutions.

Refund and replacement requests remain subject to our Return & Refund Policy and applicable consumer protection laws.

7. Bulk & Corporate Orders

Bulk, corporate, and custom-quoted orders may require additional production time, customer communication, or sample approval.

Custom pricing may depend on quantity, engraving requirements, materials, packaging, and design complexity.

Once production begins, bulk and customized orders generally cannot be canceled or returned for reasons unrelated to defects, errors, or other legally protected rights.

8. Customer-Provided Artwork

Customers submitting photographs, logos, trademarks, or other artwork confirm that they have the necessary rights or permissions for the intended reproduction.

CieloNYCDesigns reserves the right to decline orders involving suspected intellectual property infringement or unlawful content.

Original designs, product photography, branding, and other creative materials belonging to CieloNYCDesigns remain our intellectual property unless otherwise agreed in writing.

9. Pricing & Payments

All prices are listed in U.S. dollars unless otherwise stated.

Payment is required before production begins unless alternative arrangements have been agreed upon.

We reserve the right to correct pricing errors, update product availability, and modify future pricing.

If an accepted order cannot be fulfilled due to an error or inventory limitation, we will notify the customer and provide any applicable refund.

10. Product Care & Limitations

Customers should follow any care instructions provided with their orders.

We are not responsible for damage caused by improper handling, dropping, misuse, unsuitable cleaning methods, or modifications after delivery.

This does not limit claims for products that arrived defective, damaged, or materially different from the purchased specifications.

11. Website & Third-Party Services

Our website is powered by Shopify and may use third-party payment processors, shipping carriers, and service providers.

We make reasonable efforts to maintain accurate website content and reliable access but cannot guarantee uninterrupted service.

12. Limitation of Liability

To the extent permitted by applicable law, CieloNYCDesigns and Aeternis LLC are not responsible for indirect or consequential losses arising from website use, product misuse, or circumstances beyond our reasonable control.

Nothing in these Terms limits any liability or consumer remedy that cannot legally be excluded.

13. Privacy

Customer information is collected, processed, and stored in accordance with our Privacy Policy and applicable privacy laws.

14. Governing Law

These Terms are governed by the laws of the State of New York, United States, without overriding mandatory consumer protection rights applicable in other jurisdictions.

15. Changes to Terms

CieloNYCDesigns may update these Terms of Service as needed. Any changes will be reflected on this page with an updated revision date.

Revisions will not retroactively change accepted orders unless permitted by law or agreed upon by the parties.
